The “European trade mark reform legislative package” was adopted on 15th December 2015. The new Directive 2015/2436 will be transposed in France within 3 years. Regulation EC 2015/2424 which modifies Regulation EC 207/2009 shall apply as from 23rd March 2016.

The European legislative framework was finally adopted on 15 December 2015 by the European Parliament (see our news of 10 June 2015).
The new Regulation on the European trademark will come into force 90 days after the its publication in the Official Journal of the European Union which is expected in January 2016.
The new Directive will come into force 20 days after its publication and shall be implemented by the Member States within the three following years, except for the dispositions relating to the administrative forfeiture and annulment procedures which can be transposed within seven years. The French Office has however recently expressed its will to make these new procedures operational as quickly as possible.
